These Affiliate Programme Terms & Conditions (“Affiliate Terms”) govern your participation in the JamesPratt.com Affiliate Programme (“Programme”).

By applying for, enrolling in, or participating in the Programme, you agree to these Affiliate Terms, our Terms of Service, and our Privacy Policy. If you do not agree, do not participate in the Programme.

1) Eligibility and Enrolment

The Programme is open to individuals and businesses worldwide, subject to applicable local laws and restrictions. You must be at least 18 years old and legally able to enter into binding agreements.

B. Application and Approval

To join, you must submit a complete and accurate application via our online form. We reserve the right to accept or reject any application at our sole discretion, without obligation to provide a reason.

C. Account Information

You are responsible for maintaining accurate and up-to-date contact, payment, and tax information in your affiliate account.

2) Programme Participation

A. Affiliate Links

Upon acceptance, you will receive access to a unique affiliate dashboard and referral links. You may use these links in accordance with these Affiliate Terms and any guidelines we provide.

B. Promotional Methods

You may promote JamesPratt.com using ethical, legal, and brand-compliant methods, including your website, blog, email, and social media.

Prohibited methods include:

• Unsolicited commercial email (“spam”)

• Paid search bidding on our branded terms

• Misleading claims or misrepresentation

• Use of cookie stuffing, adware, or malware

• Posting affiliate links on coupon or deal sites without approval

• Any activity that violates local, national, or international law

C. Branding and Content

You may use approved JamesPratt.com marketing materials and assets provided via the affiliate dashboard. You may not alter, misrepresent, or misuse our brand, trademarks, or content. All materials remain our intellectual property.

D. Self-Referrals

You may not use your own affiliate link to purchase products or memberships for yourself, your business, or for fraudulent purposes.

3) Commissions and Payouts

A. Commission Structure

• Starter: 10% commission (entry level)

• Growth: 12.5% commission (upgrade at $2,500 net sales)

• Elite: 15% commission (upgrade at $10,000 net sales, includes free Lifetime Membership to The Digital Business Hub)

• Prestige: 20% commission (upgrade at $50,000 net sales, includes 20% discount code for referrals and free Lifetime Premium Membership to The Digital Business Hub)

B. Recurring Commissions

Commissions are paid on eligible sales generated via your affiliate links for up to 12 months per referred customer. Commissions are calculated on the net price paid by the customer after any discounts, refunds, or chargebacks.

C. Cookie Duration

Referrals are tracked with a 30-day cookie window. If a prospect purchases within 30 days of clicking your link, you receive credit.

D. Payouts

• Minimum payout threshold is $50 USD.

• Payouts are processed monthly, 30 days after the sale, via Stripe or Wise.

• You are responsible for any payment processing fees, taxes, or reporting obligations in your jurisdiction.

E. Refunds & Chargebacks

If a referred sale is refunded or charged back, the related commission will be reversed or deducted from future payouts.

F. Tier Upgrades

Once you reach a new tier, you retain that status permanently. Tier benefits (such as discount codes or lifetime memberships) are subject to verification and fulfilment within 30 days of qualification.

4) Affiliate Conduct & Obligations

A. Professionalism

You agree to conduct yourself with integrity, honesty, and respect for our brand values - including cultural inclusivity and community empowerment.

B. Compliance

You must comply with all applicable local, national, and international laws, including advertising standards, privacy laws (such as GDPR), and anti-spam regulations.

C. Prohibited Activities

You must not engage in fraudulent, deceptive, abusive, or unethical marketing practices. Violation may result in immediate termination and forfeiture of unpaid commissions.

D. Confidentiality

You may not disclose non-public information about JamesPratt.com, our customers, or the Programme.

5) Intellectual Property

A. Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use our approved marketing materials solely for Programme participation.

B. Ownership

All JamesPratt.com content, trademarks, and assets remain our exclusive property.

6) Termination

A. By You

You may terminate your participation at any time by notifying us in writing.

B. By Us

We may suspend or terminate your participation at any time, with or without cause, by written notice. Grounds for immediate termination include breach of these Affiliate Terms, fraud, or harm to our reputation.

C. Effect of Termination

Upon termination, you must cease using all affiliate links and marketing materials. Any unpaid, eligible commissions accrued prior to termination will be paid in the next cycle, unless forfeited due to breach.

7) Limitation of Liability

To the maximum extent permitted by law, JamesPratt.com is not liable for indirect, incidental, or consequential damages arising from your participation in the Programme. Our total liability is limited to the total commissions paid to you in the preceding 12 months.

8) Dispute Resolution

Any disputes will be resolved in accordance with the governing law and dispute resolution provisions in our Terms of Service.

9) Amendments

We may update these Affiliate Terms at any time. Material changes will be communicated via email or affiliate dashboard. Continued participation constitutes acceptance of any changes.

10) General

These Affiliate Terms incorporate by reference our Terms of Service and Privacy Policy. In the event of conflict, these Affiliate Terms prevail for matters specific to the Affiliate Programme.
